Terms and Conditions of Sale

PURPOSE

The purpose of these General Terms and Conditions of Sale is to define the conditions under which the Site provides the user with a digital administrative assistance service.

The Site offers a service consisting of assisting the user in carrying out an administrative procedure for contesting a road traffic offense with the competent administration, particularly via the relevant government website.

In this context, the Service exclusively includes:

  • the collection of necessary information from the user via a secure form,

  • the formal verification of the completeness of the information transmitted,

  • the technical transcription of the information provided by the user on the interface of the official administrative website concerned,

  • where applicable, the submission or transmission of the elements provided by the user to the competent administration.

The Site acts as a technical provider of administrative assistance.

The Service in no way constitutes:

  • legal consultation,

  • personalized legal analysis,

  • legal advice,

  • representation before a court,

  • or an activity falling under a regulated legal profession.

The Site does not interpret the user's legal situation and does not determine the strategy to adopt.
It merely executes, in a technical and administrative manner, the requested procedure solely based on the information provided by the user.

The user remains solely responsible for:

  • the veracity, accuracy, and completeness of the information provided,

  • the relevance of the procedure initiated,

  • compliance with applicable legal deadlines,

  • and monitoring their file with the administration.

The Site is in no way a party to the administrative procedure and exercises no control over the decision rendered by the competent authority.

Use of the Service implies full and unreserved acceptance of these General Terms and Conditions of Sale.



NATURE OF SERVICE – ABSENCE OF LEGAL ADVICE

The Service offered by the Site consists exclusively of administrative and technical assistance.

The Site acts as a service provider responsible for carrying out, on behalf of the user, an administrative procedure with the competent administration, based on the information provided by the user.

The Site's intervention is strictly limited to:

  • the collection of information necessary for carrying out the procedure;

  • the accurate and technical transcription of the information provided by the user on the interface of the administrative website concerned;

  • the transmission of documents and elements provided by the user;

  • the submission of the request to the competent administration.

The Site does not engage in any legal advisory activities.

As such:

  • the Site does not conduct any legal analysis of the user's situation;

  • the Site does not make any personalized recommendations as to whether or not to initiate a dispute;

  • the Site does not determine any legal strategy;

  • the Site does not provide any interpretation of applicable legislative or regulatory texts;

  • the Site does not represent the user before a court or administrative authority.

The Service cannot be assimilated to legal consultation within the meaning of the provisions governing regulated legal professions.

The user expressly acknowledges that:

  • the decision to initiate a dispute is solely their initiative;

  • the Site acts only as a technical executor;

  • responsibility for the adopted strategy and the content of declarations remains exclusively theirs.

The Site in no way guarantees a favorable outcome of the administrative procedure undertaken.
The competent administration remains solely responsible for deciding whether to accept or reject the request.



ADMINISTRATIVE MANDATE

In order to enable the execution of the Service, the user grants the Site an express, special and limited mandate, for the exclusive purpose of carrying out the necessary administrative procedures with the competent administration, in their name and on their behalf. The User acknowledges that Contestations.com is not a law firm and does not provide any personalized legal advice services.

This mandate is strictly limited to the following operations:

  • entering the information provided by the user on the official administrative website concerned;

  • downloading and transmitting the supporting documents provided by the user;

  • submitting the corresponding administrative procedure;

  • receiving, where applicable, technical acknowledgments of receipt related to the submission.

The mandate does not grant the Site any power to:

  • conduct a legal analysis of the user's situation;

  • modify the content of declarations beyond their faithful transcription;

  • make decisions regarding the dispute strategy;

  • represent before a court or administrative authority;

  • engage in adversarial exchanges with the administration beyond the mere technical transmission of the provided elements.

The Site acts exclusively as a technical agent for administrative execution.

The user guarantees:

  • the accuracy, sincerity, and completeness of the information and documents provided;

  • that they have the necessary legal capacity to mandate the Site;

  • that they are the legitimate holder of the file concerned or have valid authority to act.

The mandate takes effect upon validation of payment and automatically terminates upon completion of the administrative procedure concerned.

The Site cannot be held responsible for decisions made by the competent administration, nor for the consequences resulting from inaccurate, incomplete, or erroneous information communicated by the user.



LIMITATION OF LIABILITY – NO GUARANTEE OF RESULTS

The Site is bound by an obligation of means in the performance of the Service.

The Site undertakes to perform the administrative assistance service diligently and in accordance with the information communicated by the user.
However, it cannot guarantee the success, acceptance, or favorable outcome of the initiated procedure.

The competent administration remains solely responsible for deciding whether to accept, reject, or process the dispute.

The Site shall in no event be held responsible for:

  • the total or partial rejection of the application;

  • the loss of points on the driving license;

  • the maintenance or increase of a fine;

  • penalties or additional fees decided by the administration;

  • exceeding legal deadlines attributable to the user;

  • inaccurate, incomplete, or erroneous information provided by the user;

  • a malfunction of the official administrative website or a temporary unavailability of online public services;

  • a delay or error attributable to the competent administration.

The Site does not intervene in the administrative decision and has no power to influence it.

In any event, the total liability of the Site, for all causes combined, is expressly limited to the amount actually paid by the user for the Service concerned.

The Site cannot be held responsible for any indirect damage, including loss of opportunity, moral prejudice, loss of income, or indirect financial consequences related to the administrative decision.

The user expressly acknowledges that the Service constitutes technical assistance for carrying out an administrative procedure and that no guarantee of results can be expected.


FINANCIAL TERMS

The Service is provided upon payment of a fixed flat rate of forty-nine euros (€49) including all taxes (TTC).

This price corresponds to the execution of a one-time administrative assistance service as defined in these General Terms and Conditions of Sale.

Payment is due in full at the time of order.
Payment is made by the means of payment offered on the Site.

Validation of payment implies full and unreserved acceptance of these GTCs, activation of the administrative mandate provided for in Article 3, and the immediate commencement of the Service's execution.

No processing begins before effective payment confirmation.

As the Service consists of executing a personalized administrative procedure in the name and on behalf of the user, no refund can be claimed once the procedure has been initiated, the information has been transcribed on the official administrative website, or the submission has been made to the competent administration.

The rejection of the dispute by the administration does not in any way constitute grounds for a refund.

The user is required to carefully check the accuracy of the information entered before validating the payment. Any error attributable to the user shall not engage the liability of the Site nor give rise to a refund after the procedure has been launched.


In accordance with the provisions of the Consumer Code applicable to distance contracts, a user who qualifies as a consumer generally benefits from a period of fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, without having to give reasons or incur penalties.

However, in accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for services fully performed before the end of the withdrawal period if the performance began after the consumer's express prior agreement and express waiver of their right of withdrawal.

By validating their order and proceeding with payment, the user:

  • expressly requests that the execution of the Service begin immediately;

  • acknowledges that the Service consists of carrying out a personalized administrative procedure in their name and on their behalf;

  • accepts that execution begins before the expiry of the fourteen (14) day legal period;

  • expressly waives their right of withdrawal once the service has been fully performed.

Consequently, no right of withdrawal can be exercised once the administrative procedure has been initiated or submitted to the competent administration.

If, exceptionally, the execution of the Service had not yet begun at the time of the withdrawal request, it may be examined in accordance with the legal provisions in force.


PERSONAL DATA

As part of the performance of the Service, the Site collects and processes personal data necessary for carrying out the administrative procedure.

This data may include, in particular:

  • identity,

  • contact details,

  • information relating to the offense concerned,

  • supporting documents transmitted by the user.

The data is collected exclusively for the purposes of:

  • performing the Service,

  • carrying out the mandated administrative procedure,

  • ensuring technical monitoring of the service.

The data is kept for the period strictly necessary for the performance of the Service and compliance with applicable legal obligations.

It may be transmitted to the competent administrative authorities strictly within the framework of the mission entrusted by the user.

The Site implements appropriate technical and organizational measures to ensure the security and confidentiality of the processed data.

The user has a right of access, rectification, erasure, and restriction of processing of their data, which they can exercise in accordance with the Privacy Policy accessible on the Site.

 


 

USER OBLIGATIONS

The user undertakes to:

  • provide accurate, complete, and truthful information;

  • transmit authentic documents;

  • comply with applicable legal deadlines;

  • not use the Service for fraudulent or illicit purposes.

The Site cannot be held responsible for the consequences resulting from erroneous, incomplete, or falsified information provided by the user.

 


 

FORCE MAJEURE

The Site cannot be held responsible for a breach of its obligations in the event of a force majeure event as defined by applicable law and jurisprudence.

In particular, the following are considered cases of force majeure:

  • unavailability or malfunction of official administrative platforms;

  • communication network failure;

  • strikes, postal disruptions;

  • natural disasters;

  • or any unpredictable and irresistible external event.

 


 

INTELLECTUAL PROPERTY

All elements comprising the Site, including:

  • texts,

  • structure,

  • digital tools,

  • interfaces,

  • databases,

are protected by intellectual property rights.

Any unauthorized reproduction, representation, or exploitation is prohibited.

 


 

APPLICABLE LAW AND COMPETENT JURISDICTION

These General Terms and Conditions of Sale are subject to the law applicable in the country where the Site editor is established.

In the event of a dispute, an amicable solution will be sought first.

Failing an amicable agreement, the competent courts within the jurisdiction of the Site's registered office will have sole jurisdiction, subject to imperative provisions protecting the consumer.

 


 

ENTIRE AGREEMENT

These GTC constitute the entire agreement between the parties.

If a clause is declared void or unenforceable, the other provisions shall remain in force.
